    A military company commander who allegedly used racist insults against a Taiwanese-Japanese dual-national conscript was indicted on Friday, with prosecutors seeking an increased sentence, citing the commander’s abuse of authority.

    On April 7, the captain, surnamed Wen (溫), allegedly humiliated the conscript in public, calling him a “Japanese devil,” describing him and his mother as “beasts,” and saying “fuck your mother,” the Yilan District Prosecutors’ Office said in its indictment.

    Three days later, on April 10, Wen again allegedly berated the conscript over his Taiwanese-Japanese dual nationality, saying he came to Taiwan to serve in the military to “atone for his sins,” referring to him as a “damn Japanese devil,” insulting his educational background and questioning his eligibility for a service-time reduction, prosecutors said, emphasizing that the commander’s conduct was highly inappropriate.

    As company commander, Wen should have set an example, but instead abused his power by verbally abusing and discriminating against a subordinate based on his nationality, prosecutors said.

    Wen’s conduct constituted public insult under Article 309, Paragraph 1 of the Criminal Code, and met the criteria for an increased penalty under Article 134, they said.

    Article 134 of the Criminal Code applies when a public official commits an offense by taking advantage of their authority or position.

    After receiving a report about Wen’s actions, the 6th Army Corps Command said it immediately removed him from his command position, imposed disciplinary action and referred the case to judicial authorities.

    The military said that it would not tolerate any improper conduct, or lapses in training and discipline, and would continue to improve leadership and command practices to maintain morale and discipline.
